Personal Data Protection: BASIC AND ADDITIONAL INFORMATION

Processing: Access and Reuse of Public Information.

Controller: Directorate General for Transparency and Quality, with address at C/ Montalbán 1, Madrid 28014.

Purpose: To process requests for access, reuse and citizen proposals for the reuse of public information of the Madrid City Council. To manage citizen services for enquiries, comments and attention errors on the open data portal and to improve service quality through surveys, outreach activities and subscriptions. Identifying data are not deleted. They will not be used for automated decision-making.

Legal basis: The legal basis for processing is consent and compliance with a legal obligation: Law 19/2013 of 9 December on Transparency, Access to Public Information and Good Governance; Law 37/2007 of 16 November on the Reuse of Public Sector Information; Law 10/2019 of 10 April on Transparency and Participation of the Community of Madrid; and the Madrid City Council Transparency Ordinance of 27 July 2016.

Recipients: Municipal public companies, Council for Transparency and Good Governance, other public administrations.

Rights: Any person has the right to obtain confirmation as to whether the Directorate General for Transparency and Citizen Attention is processing personal data concerning them or not. Data subjects have the right to access their personal data and to request the rectification of inaccurate data or, where applicable, request its erasure when the data are no longer necessary for the purposes for which they were collected. Requests may be sent to the said Directorate General via https://sede.madrid.es (Data Protection Rights).

In certain circumstances, data subjects may request restriction of processing of their data, in which case they will only be retained for the exercise or defence of claims. Data subjects may also object to the processing of their data on grounds relating to their particular situation. The controller will cease to process the data unless there are compelling legitimate grounds or for the exercise or defence of legal claims.

If the data subject does not obtain satisfaction in the exercise of the above rights, they may lodge a complaint with the supervisory authority (Spanish Data Protection Agency).
